Training for Qualification as European Patent Attorney
Drafting & Amendment Course, Papers A-B
This 3-day course covers the processing of the facts of
the
drafting and amendment papers into an answer consisting of an
introduction
and claims, or amended claims with supporting arguments.
The topics covered include :
Day 1 - General/Drafting:
- What do the Instructions to Candidates mean?
- Reconciling obtaining the broadest possible
protection with
meeting all legal requirements
- Relating the exam to everyday work
- Getting into the right frame of mind to tackle
the exam
- Developing techniques that will help you pass
the
exam and
perform better in your work
Day 2 - Drafting:
- Assimilating the facts (clients letter and
prior
art)
- Identifying the invention to be protected
- Using the problem-solution approach in drafting
- Making a first draft claim and improving it
- Drafting the introduction (problem-solution)
- Drafting a set of claims
Day 3 - Amendment:
- Assimilating and organising the facts (patent
application,
communication, prior art)
- Identifying the residual patentable subject
matter
- Amending the claims to achieve the broadest
protection
- Developing supporting arguments
(problem-solution
approach)
- Compliance with the requirements
- Format for a reply you can also use at work
For practical work on days 2-3 we split into chemical
and
mechanical/electrical groups.
Objective :
By Saturday evening each participant should have an
organised
approach to the drafting and amendment papers of the exam using
techniques
that can be applied at work.
