Opposition Course - Paper C
This 2-day course covers processing of an opposition
paper of the European Qualifying Examination from the facts of the
question into the answer. The legal points involved and the skills
required are dealt with step-by-step and illustrated by examples and
exercises.
The topics covered include :
- Developing a plan based on the Instructions
to Candidates
- Analysing the claims and the patent to be opposed
- Establishing the state-of-the-art. Setting up a
date display
- Integrating the legal issues into planning the
opposition
- Recognising and dealing with publication problems,
priority problems, non-prejudicial disclosures
- Dealing with conflicting European applications
- Identifying the relevant parts of the prior art
documents. Establishing
a Novelty Matrix
- Developing grounds of opposition based on the
facts of the case
- Planning the structure and content of your
opposition statement
- Demonstrating lack of novelty
- Demonstrating lack of inventive step
(problem-solution approach)
- Writing the statement of opposition.
- Time saving techniques.
Objective :
By Saturday evening each participant should know how
to process the facts of a typical opposition paper, develop grounds
of opposition, plan the structure and content of the opposition and
produce a reasoned statement of opposition with accompanying
notes.
